Version terms-v1 · [date of publication]
1. Who we are
Before the Brief is a product of Create Impact Products, operated by Hieronymus Weyn (sole trader), Rua da Pedra do Cão [n.º], 4400-396 Vila Nova de Gaia, Portugal, NIF 323060404, email createimpactproducts@gmail.com, phone +49 160 94691490 ("we", "us").
2. What Before the Brief is — and isn't
Before the Brief is an online information service. We read public sources and rank companies by how likely they are to open a senior technology seat or a board seat in the next three to six months, and we send you that information by email.
We are not a recruitment agency, take no fees from employers and never contact companies on your behalf. We don't represent you, we don't put you forward for roles, and we can't promise that any role, interview or board seat will open or be offered to you.
3. The free service
- The weekly digest: one email a week with five companies, the reason and the source, also published at [your domain]/digest. You can unsubscribe at any time from any digest email.
- The free top-10: one per person (per email address), sent by email within two working days of your request. If your request falls outside what we cover, we'll tell you.
4. Paid plans
| Plan | Price | What you get |
|---|---|---|
| Executive | €49 per month | Your personal radar — the top 25 companies for your role, sectors and location, refreshed every week (Monday email briefing); a hot alert by email within a day when one of your companies changes; for each company: why now, the source, who decides and the first move. |
| Executive + Board | €99 per month | Everything in Executive, plus board seats likely to open at smaller companies (Portugal and Spain first, then the rest of the EU), with who decides on the board and the realistic route in. |
- Delivery. Everything is delivered by email: briefings and alerts from createimpactproducts@gmail.com, automated emails from our sending address on [your domain]. During our launch period, briefings are produced by our scoring engine and checked by hand; there is no members' website. Your first briefing arrives within three working days of receiving your answers to the welcome questions, then every Monday. "Within a day" for hot alerts means within one working day of the change appearing in our sources.
- Coverage. Deepest in Portugal and Spain; executive seats also in the rest of Europe, the UK, the Middle East and Africa. Coverage of any particular company, sector or country is not guaranteed.
- [Launch-period availability. During our launch period, paid plans are available to customers based in the European Union. If you're elsewhere, write to us. — keep only if you follow the EU-only recommendation in 08-payments-and-tax.md.]
- Team plans for interim firms and fractional practices are agreed separately in writing.
5. Price, payment and renewal
- Prices are in euros and include VAT where it applies. [If you use the art. 53 VAT exemption, add: "We are exempt from VAT under article 53 of the Portuguese VAT Code, so no VAT is charged."]
- You pay monthly in advance by card through Stripe. Your membership renews automatically every month until you cancel.
- You receive a payment receipt from Stripe and an invoice from us [describe: "a Portuguese invoice (fatura-recibo) by email" — see 08-payments-and-tax.md].
- If a payment fails we'll tell you by email; if it isn't fixed within 14 days we may pause your briefings.
- We may change prices with at least 30 days' notice by email. The new price applies from your next renewal after the notice; you can cancel before it takes effect.
6. Your right of withdrawal (consumers)
If you are a consumer, you have the right to withdraw from a paid plan within 14 days of the day you bought it, without giving any reason.
How to withdraw: use "Withdraw from contract here" at [your domain]/withdraw (fill in your name, the email you paid with and which contract, then press "Confirm withdrawal"), or send us a clear statement by email to createimpactproducts@gmail.com. You may use the model form below, but you don't have to. We'll acknowledge your withdrawal by email straight away.
Starting straight away. At checkout you can ask us to start your membership immediately, during the 14 days, and confirm that you understand that you lose your right of withdrawal once we have sent your first briefing. If you do so:
- before your first briefing is sent, you can still withdraw and get a full refund;
- once your first briefing has been sent, the right of withdrawal ends for that payment — you can still cancel at any time (section 7), so no further payments are taken.
[Lawyer to choose: the text above treats the briefings as digital content supplied once performance has begun (Directive 2011/83/EU, Art. 16(m)). If your lawyer classes the paid plan as a service, replace the two bullets with: "If you withdraw after we have started, you pay a proportionate amount for the days before you told us you were withdrawing, and we refund the rest" (Art. 14(3)).]
[Optional goodwill clause for the launch period: "During our launch period, if you withdraw within 14 days of your first payment we refund it in full, even after your first briefing."]
Refunds. We refund all payments due to you within 14 days of receiving your withdrawal, using the same payment method, at no cost to you.

7. Cancelling
You can cancel at any time from the "manage or cancel" link in every member email (it opens Stripe's customer portal; enter your email and you'll receive a login link), or by replying to any of our emails. Cancellation takes effect at the end of the period you have already paid for; you keep your briefings until then and no further payments are taken. Apart from your rights in section 6 and the law, we don't refund part-months.
8. Accuracy and how you use the information
- Our likelihoods and bands are estimates, not promises, based on public information that may be incomplete, out of date or wrong. Treat each one as a reason to look closer, and check the source before you act.
- We don't give investment, legal, tax or career advice. You decide whether, how and when to contact anyone.
- When you approach people or companies, respect their privacy and the law, and don't say or imply that Before the Brief introduced you or acts for you.
9. Your licence and fair use
Your briefings and lists are for your own personal use. Please don't resell, publish, share or forward them, or use them to run a recruitment or search business — ask us about a team plan instead. We may suspend a membership that breaks this section, after telling you why where reasonable.
10. Our responsibility
We provide the service with reasonable care and skill. Nothing in these terms limits your statutory rights as a consumer, including your rights if the digital content or service isn't as described. Where the law allows, we are not responsible for decisions you take based on the information, or for losses that weren't foreseeable. If you buy as a business, our total liability is limited to the fees you paid in the 12 months before the claim.
11. Changes to the service or these terms
We may improve the service. If we change these terms in a way that matters to you, we'll email you at least 30 days before; you can cancel before the change takes effect.
12. Complaints and disputes
Please write to createimpactproducts@gmail.com first; we reply within five working days. You can also use the electronic complaints book (Livro de Reclamações) at https://www.livroreclamacoes.pt. If we can't resolve a dispute, you can go to a consumer alternative dispute resolution (RAL) entity: [name of the competent RAL entity, its website and contacts — for example CICAP, the Porto consumer arbitration centre (www.cicap.pt), or CNIACC, the national centre (www.cniacc.pt); your lawyer will confirm which applies]. More information: Portal do Consumidor, www.consumidor.gov.pt.
13. Law and courts
These terms are governed by Portuguese law. If you are a consumer living in another country, you keep the protection of the mandatory consumer rules of your country and can bring a claim in your local courts.
14. Business customers
If you buy for a business (including team plans), sections 6 and 13 (second sentence) don't apply, and any written team-plan agreement prevails over these terms.
